General Terms and Conditions (GTC) of Galerie Kunsthandeln GmbH

  1. scope of application

    These General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders and deliveries of works of art and art objects made via the website or on the premises of Galerie Kunsthandeln GmbH (hereinafter referred to as "Seller").

  2. No right of withdrawal

2.1 For the purposes of these General Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed to their commercial or independent professional activity.

2.2 In the case of contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive (e.g., individually produced works of art), there is no right of withdrawal in accordance with Section 312g (2) No. 1 BGB.

2.3 The right of withdrawal is also excluded for goods that are not suitable for return due to their nature (e.g., unpackaged or loose art objects).

  1. Exclusion of returns

3.1 Since works of art are unique items, returns and exchanges are excluded. The seller will only accept returns in the event of obvious transport damage or a deviating, incorrect delivery.

3.2 Complaints regarding transport damage must be reported immediately, at the latest within three working days of receipt of the goods, in writing by email to info@kunsthandeln.de.

  1. warranty

4.1 The statutory warranty provisions apply. Obvious defects must be reported in writing within two weeks of delivery of the goods.

4.2 In the event of justified complaints, the seller shall, at its discretion, either repair the goods or deliver a replacement. If this is not possible, the buyer may demand a reduction in price or withdraw from the contract.

  1. Final provisions

5.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

5.2 Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
